1. Acceptance of Terms

By accessing or using Playglow (“Platform”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not use the Platform.

You must be at least 18 years old to use Playglow.

2. Platform Role

Playglow is a technology platform that enables users to discover events, participate in experiences, connect with others, and share content.

Playglow does not organize, host, manage, or control any events. All events are created and operated by independent third-party hosts.

Playglow is not a party to any agreement between users and hosts.

3. Events and Participation

When you RSVP to or attend an event, you acknowledge that the event is hosted by a third party and not by Playglow.

You are solely responsible for evaluating the event, the host, and your participation.

Playglow does not guarantee the safety, legality, quality, or accuracy of any event.

4. Assumption of Risk

By participating in any event, you voluntarily assume all risks, including but not limited to:

• Physical injury, illness, or death

• Property damage or loss

• Interactions with other participants

These risks may arise from sports or physical activity, venue conditions, or the actions or negligence of other users or hosts.

Your participation is entirely at your own risk.

5. Release of Liability

To the fullest extent permitted by law, you release and discharge Playglow and its officers, employees, and affiliates from any claims, liabilities, damages, or losses arising out of:

• Your participation in events

• Interactions with other users

• Actions or omissions of hosts

• Venue conditions

6. User Accounts

You agree to provide accurate information and maintain the security of your account.

You are responsible for all activity under your account.

Playglow may suspend or terminate your account at its sole discretion for violations of these Terms or for unsafe, abusive, or fraudulent behavior.

7. Hosts and Responsibilities

Hosts are solely responsible for:

• Organizing and operating events

• Ensuring safety and legal compliance

• Providing accurate event details

• Managing cancellations and refunds

Users are responsible for their own conduct and for complying with applicable laws and venue rules.

Playglow is not responsible for event outcomes, host conduct, or disputes between users and hosts.

8. Payments, Fees, and Refunds

Playglow may charge platform fees, event-related fees, or fees for optional features and subscriptions.

Payments are processed through third-party providers such as Stripe, Apple, or Google. Playglow does not control these payment systems and is not responsible for payment errors or failures.

Refund policies are determined solely by the event host. Playglow is not responsible for refunds, cancellations, or payment disputes.

9. Connections and User Interactions

Playglow provides features that allow users to:

• Express interest in other users

• Form connections based on mutual interest

• Communicate after a mutual connection is established

Playglow does not verify user identities or conduct background checks.

You are solely responsible for your interactions with other users, whether on or off the Platform.

Playglow is not responsible for the behavior, actions, or conduct of any user.

10. User Conduct

You agree not to:

• Harass, threaten, or harm others

• Engage in illegal or unsafe activities

• Misrepresent your identity or event details

• Use the Platform for fraud, scams, or exploitation

Playglow may remove content or suspend accounts for violations of these Terms.

11. User-Generated Content

By posting content on the Platform, you grant Playglow a worldwide, non-exclusive, royalty-free license to use, display, distribute, and promote such content.

You represent that you own or have the rights to the content you post and that it does not violate any laws or third-party rights.

Playglow may remove content at its sole discretion.

12. Content Moderation

Playglow reserves the right to remove or restrict content and to suspend or terminate users for violations of these Terms. Playglow is not obligated to monitor all content or take action in every case.

13. Filming and Likeness

By using the Platform or attending events, you acknowledge that you may be photographed or recorded.

You grant Playglow the right to use your image, voice, and likeness in content for platform, promotional, and marketing purposes.

14. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

Playglow makes no warranties regarding the reliability, availability, accuracy, safety, or performance of the Platform or any events.

15. Limitation of Liability

To the fullest extent permitted by law, Playglow is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or opportunities.

Playglow’s total liability for any claim will not exceed the greater of:

• The amount you paid to Playglow in the past 12 months, or

• $100 USD

16. Indemnification

You agree to indemnify and hold harmless Playglow and its affiliates from any claims, damages, or expenses arising from:

• Your use of the Platform

• Your participation in events

• Your content or conduct

• Your violation of these Terms

17. Arbitration and Class Action Waiver

Any disputes arising out of or relating to these Terms or the Platform will be resolved through binding arbitration on an individual basis.

You agree not to participate in class actions or class-wide arbitration.

18. Termination

Playglow may suspend or terminate your access to the Platform at any time, without notice, for any reason.

19. Changes to Terms

Playglow may update these Terms at any time. Continued use of the Platform after changes means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the State of Ohio, United States.
